Terms and Conditions
Booking and Payment:
- Deposit: A non-refundable deposit of 30% of the total cost is required to confirm your
- Registration: A non-refundable registration fee of 1,000 is applicable for all trek Note that the registration fee is non-refundable under any circumstances. Full Payment: Full payment must be made 10 days prior to the departure date.
- Late Payments: Failure to pay on time may result in cancellation of your booking.
- Payment Confirmations: Payment Confirmations will be sent to mail and any queries and issues shall be discussed with Sumeru Summits before the final Confirmation.
- Seasonal/Occasional Offers and Exclusive Packages: Please note that all seasonal/occasional offers and exclusive packages are subject to the discretion of Sumeru Summits and are only valid for a limited time. All offers and packages must be redeemed within the specified period, including the mentioned date and time. In the event that any offer or package is not redeemed within the aforementioned specified time frame, the offer shall automatically lapse and shall no longer be available for redemption.
Cancellation Policy:
Cancellation by Client:
More than 30 days before departure: Loss of deposit.
15 days before departure: 50% of total cost.
10 days before departure: 75% of total cost.
Less than 10 days before departure: 100% of total cost.
Cancellation by Sumeru Summits:
In case of unforeseen circumstances like government restrictions, natural disasters, or insufficient participants, Sumeru Summits reserves the right to cancel trips. In such cases, refunds will be issued minus any non-recoverable costs.
Health and Fitness:
Clients must ensure they are physically and mentally fit for trekking. Sumeru Summits requires a medical certificate for treks involving high altitudes or strenuous activity.
Any undisclosed health issues that could affect the trek are the responsibility of the client and Sumeru Summits remains indemnified from any and all adverse possibilities due to this including injury, health complication or loss of life
Sumeru Summits reserves the right to refuse participation if your health condition could pose a risk during the trek.
Insurance
All participants must have comprehensive travel insurance covering medical evacuation, emergency medical treatment, and trip cancellation. Proof of insurance is mandatory before departure. In case of any untoward incidents during the trek, the client will be responsible to bear their own medical expenses
Itinerary Changes:
Sumeru Summits reserves the right to alter the itinerary, trek routes, or accommodations for safety, weather, or local conditions. No refunds will be provided for such changes.
Liability:
Sumeru Summits, along with its employees, agents, or affiliates, shall not be held liable for any injury, death, loss, damage, or expense incurred by participants or any third party due to:
Adverse Weather Conditions: Including, but not limited to, circumstances involving rain, snow, high winds, or any other meteorological phenomena that may pose risks or hazards.
Natural Disasters: Such events encompass, without limitation, earthquakes, landslides, avalanches, floods, or any other acts of nature which might result in harm or loss.
Undisclosed Health Issues: Liability is expressly disclaimed for any adverse outcomes stemming from undisclosed or known pre-existing medical conditions of participants.
Death: Irrespective of the cause, should death occur during the trek, Sumeru Summits, its employees, agents, or affiliates bear no responsibility or liability.
Force Majeure: This includes any event beyond the control of Sumeru Summits such as, but not limited to, political unrest, strikes, acts of war, terrorism, or any other unforeseeable circumstances which might impede, delay, or necessitate cancellation of the trek or related activities.
By participating in any activity organized by Sumeru Summits, individuals acknowledge and accept these terms, understanding that all risks associated with these conditions are assumed by the participant.
Responsibilities of Participants:
Participants must follow all instructions from guides, respect local customs, and take responsibility for personal belongings.
Equipment and Personal Belongings:
Sumeru Summits is not responsible for the loss, damage, or theft of personal belongings during the trek. Participants are encouraged to insure their personal items.
Governing Law:
This agreement shall be governed by and interpreted in accordance with the laws of India.
Dispute Resolution:
Any disputes will be subject to the jurisdiction of the courts in the location where Sumeru Summits is registered.
Limitation of Liability:
Sumeru Summits shall not be held responsible or liable for any sociopathic or illegal behavior exhibited by past participants of our treks. Furthermore, Sumeru Summits shall not be liable for any legal or investigational consequences arising from such behavior.
Disclaimer for Sumeru Summits
Disclaimer Notice:
By participating in any trek organized by Sumeru Summits, you acknowledge and agree to the following:
Assumption of Risk: Trekking involves inherent risks, including but not limited to physical exertion, exposure to extreme weather conditions, altitude sickness, wildlife encounters, and the possibility of accidents. By booking with Sumeru Summits, you voluntarily assume all risks associated with these activities.
Liability Waiver: Sumeru Summits, its guides, employees, and affiliates shall not be held liable for any injury, illness, death, loss, or damage to personal property, whether caused by negligence, adverse weather, natural disasters, force majeure, or any other cause beyond our control. This waiver includes but is not limited to, any claim for compensation or damages for personal injury or death.
Health Disclosure: Participants are required to disclose any medical conditions that could affect their ability to undertake the trek. Failure to disclose such conditions absolves Sumeru Summits of all liability
related to these undisclosed issues.
Force Majeure: Sumeru Summits will not be liable for any failure or delay in performance due to circumstances beyond our control, including acts of God, war, terrorism, strikes, or government regulations.
Accuracy of Information: While we strive to provide accurate information, Sumeru Summits does not guarantee the accuracy, completeness, or usefulness of any descriptions or representations made regarding the treks or services.
Use at Own Risk: Trekking is an activity undertaken at your own risk. Sumeru Summits provides guidance and support but cannot guarantee your safety against all eventualities.
Usage of Trekking Data & Photographs: Sumeru Summits reserves the irrevocable, royalty-free, perpetual, worldwide right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display any feedback, promotional materials, photographs, videos, or testimonials provided by or depicting participants, in any form, media, or technology now known or later developed, for any purpose including but not limited to marketing, advertising, and promotion, without further notice, consent, or compensation to the participant.
By signing up for a trek with Sumeru Summits, you confirm that you have read, understood, and agree to this disclaimer and the Terms and Conditions provided.
